Observations

In the words of a top EU legal expert to us this morning:

“The EU has moved too early, before the end of transition how can the EU know if it is us or them that has failed to conclude a deal? How can debating something in a democratic parliament be a breach of a treaty? What about UN rights to self-determination? There can be no better evidence that the Withdrawal Agreement is an affront to democracy.

“The EU move is more evidence of bad faith - using a possible but not yet actioned breach as a pretext for legal action timed for the purposes of maximum negotiating impact.”

We concur with this barrister. The idea of the EU bringing an action against the UK for acting in bad faith is almost laughable, in our opinion. In the four plus years of negotiations with the European Union the United Kingdom has experienced almost nothing other than bad faith from the EU's federalist zealots.

The EU wrongly seizes the high ground again

For years we have been trying to get the basics through to the UK Government - Mr Cameron's, then Mrs May's, and then Boris Johnson's. When WILL they ever listen?

The EU does not act rationally, nor as a friendly partner. Especially since the British people voted to leave the EU over four years ago. Does the world know this? No, they do not.

We must now increase the pressure on the UK Government to repudiate the Withdrawal Treaty in its entirety, to explain over and again what the UK has been through with the EU, and to call the EU out as having acted in bad faith for years.

Screw the EU! They have NEVER acted in good faith from the very beginning & everyone know's it, including the pathetic,whinging Remoaners within the UK! The case is going up in front of THEIR court's so,is that acting in 'good faith' also? Is taking a legal complaint to you're own court's in itself legal?! After all,any court in any land are supposed to be impartial & unbiased towards any case! Will this 'case' be impartial & unbiased?! We all know the answer to that one, don't we! If the EU pursue this to any length,then we MUST walk away as soon as possible! NOW even! Level Playing Field,from the EU,no F-ing chance!

All they want is for us to be tied to the one sided WA that treason may concocted with them.
Send them a letter tomorrow Mr Johnson.

The UK will leave the EU under WTO rules.

Just because the UK has no bargaining power or ability does it mean the EU is acting in "bad faith". I suggest you just quit crying about this like spoiled children, and just accept the consequences of your bad decisions. Cheers.

Quite apart from the questions about the EU's own lack of good faith - in particular their threats to use the NIP to impose a blockade on NI - they are putting themselves into a strange position. By the end of October, if the negotiations succeed, they ought to be making plans to ratify whatever FTA emerges from the negotiations, but I don't see how they can do that if they have also begun legal proceedings in the ECJ. It seems that they have deliberately tied their own hands by making it impossible to ratify, while continuing to negotiate, or pretend to.
If this is the case, and they are not simply blundering, then it looks to me as though the whole affair of threatening to misuse the NIP was itself a mechanism to sabotage the negotiations. A way of saying "We want to complete the process, but Oops, look, a Court case, so now we can't". Of halting the negotiations without looking as if it's their own decision.
If so, this is very good news for the people who already wanted to halt the FTA negotiations and denounce the WA. Now Frost can just walk away and let the EU pretend they didn't halt the process, but the EU Courts did. As if EU "Courts" are real Courts and not just an extension of their executive.
In the longer term, now we won't have a "top down" FTA and instead we will do the same thing "bottom up" as a series a individual agreements are written in different areas - food, manufacturing, fishing, banking and so on. We will have exchanged a much longer negotiating process - this could take years - for getting rid of *any* EU jurisdiction over the UK, which is what a lot of pretty sensible people now want.

I think it's worth asking why the UK negotiated a WA in the first place. We did not have to, since Article 50 says you can leave the EU "with or without" such an agreement. For example, we could have told the EU that if they had to "protect" the Single Market without a hard border in Ireland, then that was their problem, not ours, since we had no intention of erecting such a border.
The reason we did negotiate a WA was that it held out the inducement of a Free Trade Agreement. No WA; no FTA, which is fair enough.
But what if the EU held out the prospect of an FTA knowing that they would never agree to it except under unreasonable conditions? For example, their control of our waters, our state aid, EU Court jurisdiction, and so on. If they intended to crash the FTA negotiations from Day One by imposing unreasonable conditions that they would not impose on any other trade partner, then that could not possible be called "good faith" and then we can walk away from the WA. *All* of it.
And what were we told about the FTA? We were told that we were negotiating with an EU position agreed in advance by all 27 EU members, excluding us. So, if they knew in advance that their - then confidential - position had to lead to a failure in FTA negotiations, they were holding out an inducement they intended not to deliver on. And then even their WA negotiations were not conducted in good faith.

The EU throws another card onto the table in this never ending game of political poker. This latest move is reminiscent of German and French political posturing in the 19/20th century. There would appear to be differing legal opinion regarding our next move Article in this mornings brexit watch . org "Take the Eu to court in the Hague for breach of UN resolution 2625" the rights of self determination. I have lived in hope these past four years that our rancid duplicitous political establishment would eventually realize that the EU is a malevolent foreign entity with the desire to inflict harm on the UK. I am now of the opinion that if this government had any intention of walking away with its head held high and the aspirations of the brexit vote adhered to it would have happened by now. I now fear that the mother of all political stich ups is imminent and as a consequence, the breakup of the UK.
