Law to be passed next year to force UK car manufactures to comply, even if they never sell to the EU
In July this year we revealed the early warning of a major reversal of Brexit by Sir Keir. Now, in a bombshell revelation we can reveal it’s actually happening, with the Government slipping out the news that it will be legislating to enforce EU regulations on the British car industry, regardless of where their cars are sold. This news has been slipped out just before Christmas in the hope nobody notices.
Sir Keir reckoned without Facts4EU, however. Today we can bring readers the extraordinary news contained in a notice from the Transport Department.
Brexit Facts4EU has obtained proof that one of Britain’s most vital industries — automotive — is being forced to abandon UK regulations and fully align with EU rules. This seismic shift, just years after Brexit promised regulatory freedom, marks a dramatic U-turn with far-reaching consequences.
This presents a major blow to British industry, and a likely surge in prices for consumers — on a scale that will be felt profoundly across the country. This applies to all cars sold in the UK, as well as cars that will be sold around the world.
This was massive news in July
In July we published a very popular report which was then covered by GB News. It announced the Government was asking that all GB-manufactured cars be made to EU rules. We warned that this represented a reversal of Brexit. At that point, legislation was not immediately proposed, as it was hoped it would happen voluntarily.
Following a lack of interest from GB manufacturers, the Government has just announced that it will legislate to make this happen, as manufacturers are not doing it voluntarily. This means extra costs which will be passed on to consumers, which could make new cars several thousand pounds more expensive.
Here is how the news was announced
“Today (18 December 2025), the government is confirming that it intends to legislate to mandate that vehicles placed on the market in Great Britain (GB) must hold dual GB and EU type approval and marking, enabling their sale in both Great Britain and Northern Ireland, in the absence of evidence that manufacturers are doing so voluntarily. I am also today publishing a call for evidence on this approach.”

The call for evidence is only to the industry. The public will not be asked how they feel about their new car holding “dual GB and EU type approval and marking”. And the industry only has effectively four weeks before the ‘consultation period’ closes.
Given the news starts with the announcement the Government will be legislating, the consultation period seems rather superfluous. It is clearly there for show.

Burying bad Brexit news just before Christmas, under a “call for evidence”
This news was buried in an item about a “call for evidence”. This is hardly likely to make anyone want to click and read it, and we are certain this was the point of it. In the list of news headlines there wasn’t a word about EU legislation applying in mainland Britain. Nevertheless, we clicked on the link and only then found the announcement that legislation had been decided upon.

Why is Starmer doing this?
The Government wanted “manufacturers to mark vehicles to show they have both EU and GB approvals – ‘dual marking’ – and the government fully expects that vehicles will be dual marked”. We knew this was unlikely, given the fact that almost half of cars exported do not go near the EU. This has turned out to be the case.
“While the majority of vehicle models are being dual marked, I am aware that some are not.”
“This government therefore intends to legislate to mandate dual marking if there is not a clear commitment from industry to make this the default approach for vehicles sold in the UK.”
“I am pleased to inform the house that today I am publishing a call for evidence on the approval and marking of road vehicles placed on the market in Great Britain”

What does this mean for our new UK-made cars?
Put simply, all GB cars will have to be made to EU regulations, whether they are being sold in the UK or in 100 markets around the world.
It doesn’t matter if:
- Some of these regulations will make the cars much more expensive
- They are never sold in the EU
- A large number of countries worldwide accept UK regulations as being amongst the best in the world
- Nearly half of all cars exported are sold worldwide, not to EU countries
All cars in GB will have to be made to EU regulations. If those regulations change, UK manufacturers will have to change their cars to match the new regulations – the so-called ‘dynamic alignment’.
Observations
For UK car manufacturers, life is going to seem like they are back in the EU. Those who haven’t done so will have to change various parts of the vehicles they manufacture to conform to EU regulations and will then have to keep doing so each time the EU’s regulations change. They will also have to change their pricing and all their promotional material and signage.
Those whose cars are exported but are never sold in the EU (nearly half of exporters) will no doubt be irritated that they are having to do this. Those whose vehicles are never exported at all will feel even more annoyed. These is nothing they can do. As soon as the Government’s new law is on the statute book, that will be that.
We confidently predict that the new law will be in the form of a Statutory Instrument, meaning there is no requirement for a House of Commons debate. Furthermore, we believe this will be the first of many in this coming year.
