The dictatorial and unelected EU Commission has just taken further legal action against more than half its member countries. Not one member is free of legal or financial threats from Brussels, which now total almost 2,000 active cases in all.

And – despite Brexit – the United Kingdom is also in the dock.

On Tuesday the EU Commission announced it is “adopting a package of infringement decisions due to the absence of communication by Member States of measures taken to transpose EU directives into national law” (referred to as ‘non-communication infringements').

Almost 2,000 active infringement cases are currently being pursued by the Commission

Facts4EU.Org has accessed the EU Commission’s legal infringements database to review the veracity of the EU’s claim to be a bloc where “the rule of law” applies.

So numerous are the EU’s laws, directives and regulations that the Commission is now actively pursuing 1,990 infringement cases against its member countries. Every single one of the 27 is in the dock.

It might surprise readers to learn that the UK is also in the dock, despite having left the EU. Facts4EU.Org will be reporting on this separately tomorrow.

What did the EU Commission (“the prosecution”) do on Tuesday?

On Tuesday (29 Nov 2022) the EU Commission announced it is sending a letter of formal notice to those member countries who have failed to notify national measures transposing directives, whose transposition deadline expired recently. In this case, there are 15 member countries who are alleged to have not yet notified full transposition measures for 14 EU directives in the fields of environment and transport.

The nature of the alleged crimes against the EU Commission

Alleged crime no.1 : Updated requirements for technical roadside inspections

The Accused : Belgium, Bulgaria, Denmark, Germany, Ireland, Cyprus, Lithuania, Luxembourg, Hungary, Malta, Austria, Poland and Finland

Commission Delegated Directive (EU) 2021/1716 updates the roadside inspections technicalities and broadens the scope of vehicle categories subject to roadside inspections, such as high-speed tractors.

Alleged crime no.2 : Updated requirements for periodic roadworthiness tests for motor vehicles

The Accused : Belgium, Bulgaria, Ireland, Cyprus, Luxembourg, Hungary, Malta, Poland, Portugal and Finland

Commission Delegated Directive (EU) 2021/1717 amends the practicalities of the periodic roadworthiness tests for motor vehicles and their trailers, notably by updating certain vehicle category designations (high-speed tractors, powered two- and three-wheelers and quadricycles). It also adds eCall, a system sending automated messages to the emergency services following a road crash, to the list of items which should be subject to periodic roadworthiness tests.

Alleged crime no.3 : Clean and circular electronics

The Accused : Belgium, Denmark, Croatia and Portugal

In December 2021, the Commission adopted twelve delegated Directives ending a broad range of existing exemptions for the use of mercury in lamps. Under Directive 2011/65/EU (RoHS Directive), electronics that contain mercury cannot be placed on the market, except if time-limited and application-specific exemptions are granted by the Commission.

Observations

The 'rule of law' in the EU

Since the British people’s vote to leave the EU, listening to the EU Commission readers might be forgiven for thinking the United Kingdom is the least law-abiding country in the world.

Given the Commission’s announcement on Tuesday that it was commencing more of its legal processes against 15 of its member countries for yet more transgressions, Facts4EU.Org thought it would be interesting to analyse the EU’s own database of “law breaking” amongst its remaining 27 member countries.

Discovering that the Commission’s home country of Belgium ranks as the worst ‘law-breaker’ in the EU should perhaps have come as no surprise, considering the sclerotic and fantasy world inhabited by Brussels autocrats.

Tomorrow we will look at the cases the EU Commission has been bringing against the UK.

“Cruising through the news in the early hours of each morning can be a depressing experience. Sometimes, however, an item stands out from the daily grind of politics and economics.
“This morning’s sad news of the death of Christine McVie - legendary British musician, songwriter and pivotal member of the supergroup Fleetwood Mac - made me forget the EU and Brexit for a while. I could hear all of her songs in my head without even putting on a CD.
“Christine was a fine woman who warmed the hearts of all who met her. Last night's news has made the news globally - something she would no doubt have found embarrassing in her very modest English way.
“Our condolences go to her family, her friends, and all the musicians who were fortunate enough to play with her. Christine, I shall miss you.”

We must get reports like this out there

Facts4EU doesn’t seem to understand what EU law is, how it works and why it is important.
EU law is law to which member states have agreed. They have signed up for it - and the court is simply a mechanism to help enforcement.
All EU countries find themselves in breech of EU law sometimes, it is complicated after all. The UK was actually pretty good - most of the times we fell foul of EU it concerned environmental rules. Sewage in particular and the way we dealt with it. As we can see with what the Tory Brexitists have done with sewage since the referendum it turns out EU law was best.
Anyway, the attitude of Brexitists to EU law is, frankly, juvenile. Most EU law is perfectly good law. The idea that scrapping it all will make our country better is the silly sort of toddler stuff which you expect from Brexitists. Rather than fixing those EU laws which maybe are bad the Brexitists think scrapping it all sensible.

Facts4EU have massively inflated this as an issue. The majority of this is the day to day boring administration of government just as the UK may do with Local Government. This piece makes out the EU is undemocratic but the UK has an unelected House of Lords and 60% MP's are in safe seats. More significant is the EU finalising a law on Wednesday that will allow the EU to take retaliatory measures, including sanctions against the UK if it refuses to implement the terms of the Brexit agreement. The "You Vill obey us" comment, deliberately hinting at WWII and Nazi's is insulting.
Well done for the tribute to Christine McVie, amazing talent and great band, sad news.

I must first say RIP Christine McVie. A great loss to our music industry who will be sadly missed after giving decades of pleasure. Condolences to her family.

The EU Commission don't have a care in the world because they don't have to stand before the EU27 electorates.
Without doubts, the commission act as a 'dictatorship' in my opinion.
It is time the peoples of the EU27 TOLD their respective governments they will have no more Commission interference in their domestic affairs?
Perhaps also time EU27 elites were voted out of their elected office - after all, why are domestic governments necessary when they answer to a dictatorial commission.
Hopefully the peoples of the EU27 will turn on the commission and say ENOUGH IS ENOUGH - NO MORE?
Do they want democracy, or to live under the cosh of a [mainly] foreign unelected and unaccountable construct.
No country needs to be a member of the EU to trade. Last time I looked, the USA is not a member of the EU, and would never subject US citizens to a commission dictatorship, or anything like it.

I have read the first thing on Facts4EU I agree with - a tribute to the wonderful Christine McVie. Fleetwood Mac are ace.
Of course there are few British industries more devastated by Brexit than music and the creative arts. Industries for which free movement is essential but which the Brexitists have taken away.
Think The Beatles in Hamburg. That wouldn’t happen for upcoming British bands anymore because the musicians would need work visas, they’d need carnets for their equipment and so on - and that isn’t how the modem world works. Plus the nature of music industry is now about touring - and Brexit devastates the British music touring industry.
It isn’t just music either. Film, photography, fashion, sport, architecture, engineering, science - sectors in which we excel damaged beyond repair by Brexit.
By telling Little Lies in pursuit of your Brexit Albatross you decided to Go Your Own Way and now rather than being able go Everywhere in Europe as we pleased we are stuck like The Chain on Plague Island with all of you, whilst your Brexit Dreams come crash down like a Landslide on young Britons.

In fact, I think many rejoiners don't know much about the EU, and don't really care, because it's unimportant. They just see joining the EU as a difficult and humiliating thing for the UK to do, a kind of punishment, and that is their real agenda. This is why they never tell us anything factual or concrete about the EU; it's because its main importance to them is as a weapon to use against the UK. It's their hatred of the country they live in.

Andy In addition, the UK already offers visa-free one, three and six-month entry for musicians and other artists provided they are sponsored by a UK organization or are performing at recognized festivals. The real difficulty is in the UK to EU direction, so as usual the UK is being blame for EU obstructionism. It's our Brexit, so we are blame for their lack of good faith.

I just noticed this gem from Buster "Rather than fixing those EU laws which maybe are bad the Brexitists think scrapping it all sensible." It is completely untrue. The proposal is to remove the special status of EU law and then to decide what to repeal.
