With ink still drying on proposed law’s wording, embattled PM finally to be forced out of silence

It is a little unusual for a Member’s Bill to be presented to either House of Parliament without notice, albeit not unprecedented. At 10am this morning, Fri 05 June, a Bill will be read at first reading which falls into this category. Not only will the ink scarcely have had time to dry on the last-minute amendments advised on by the Clerks, it will also be the last thing our embattled Prime Minister will want to be told about.

With all the other things on his mind, from the upcoming Makerfield by-election, to Peter Mandelson, to the late Henry Nowacs, Sir Keir Starmer may have hoped no-one would notice he has said nothing about the Government’s seemingly aborted plans to give away British territory to the Chinese ally, Mauritius, together with large amounts of UK taxpayers’ money.

The latest news was that the Government had lost its case in the British Indian Ocean Territory (BIOT) Court. With President Trump’s last word being that they would not approve the transfer, a silence has descended from No.10.

All this is about to change

The Brexit Facts4EU think-tank has obtained a copy of the new Bill to be announced in Parliament today, which aims to prevent the Government from resurrecting the sovereignty giveaway permanently.

““The previous legislation on the Chagos Islands proposed by the Government last year was a shameful exercise seeking to implement a shameful attempt to implement a shoddy deal done with Mauritius.

“It aimed to hand over territory which has been British for over two centuries, and not even give it away but worse than that, hands it over with an expensive present to Mauritius stretching into many billions of pounds. Most appallingly of all it purported to do so over the heads of the Chagosians themselves, without even a guaranteed right of return.

“Wider world circumstances forced the Government to pull the Bill, and it is welcome that it is missing from the King’s Speech. But they have not abandoned it entirely, and this leaves the Chagosians in the worst of all worlds.

“My Bill which I am introducing tomorrow seeks to end that uncertainty. It restores British sovereignty over the islands as well as the Diego Garcia military base. It prevents any future transfer of sovereignty unless there is the explicit consent of Parliament, any Chagosian government and above all the Chagosians themselves as expressed through a referendum.

“It places the Chagosians at the heart of controlling their own destiny through a guaranteed right of return and a key voice in any significant decisions about the Islands. The principle of self determination is a key British value and this Bill points the way forward.

“For decades the Chagosians have been treated abysmally. This is the first step to start putting that right.”

What the new Chagos Bill says

The new Bill, sponsored by Lord Weir of the DUP, starts as follows:-

British Sovereignty Protection (Chagos Islands) Bill

“A Bill to affirm and protect the sovereignty of the United Kingdom over the Chagos Islands and the British Indian Ocean Territory; to make provision restricting the cession or transfer of sovereignty without the approval of Parliament and without the consent of the Chagossian People; to provide for the protection of the Territory’s strategic and defence importance; and for connected purposes.”

This Bill covers every protection its authors could think of, including six major areas:

Clause 1. Approval of any transfer of British sovereignty over Chagos Islands

This clause is designed to create a three-stage sovereignty protection on the transfer of the British Indian Ocean Territory. Any local Government, a referendum of Chagossians and an Act of Parliament. It also ousts international legal challenges.

Clause 2. Approval of Parliament to transfer of money

This clause is designed to allow Parliament to scrutinise any proposed payments to Mauritius connected to the sovereignty of BIOT.

Clause 3. Protection and Resettlement of the Chagossian people

(1) To repeal s. 9 of the British Indian Ocean Territory (Constitution) Order 2004 on the right to abode in the Territory consequent on the ruling of the BIOT Supreme Court that quashed the section.

(2) (a) & (b)To create a duty for the BIOT Immigration Officer to grant permits to BIOT Citizens to reside in certain of the BIOT Islands and visit the other islands unless they are a threat to the security of the base or other residents. This would allow resettlement while safeguarding the base.

(2) (c) To create a duty for the BIOT Immigration Officer to grant permits to British Citizens necessary for the maintenance of the residents unless they are a threat to the security of the base or other residents.

To create a duty for the BIOT Immigration Officer to grant permits to ‘suitably qualified’ BIOT Citizens and their descendants in receipt of employment contracts to work on the Base. The wording for ‘suitably qualified is taken from the UK Mauritius 2025 Treaty.

(3) & (4) The wording in this clause comes from Article 10 of the UK Mauritius agreement which sought to privilege Mauritian employees and contractors. This wording would confer those privileges onto the citizens of BIOT.

(5) This clause seeks to ensure that round table talks on the future of the Chagos Islands are conducted with the Chagossians. This includes resettlement, the Marine Protected Area, Cultural sites (i.e Churches and graveyards), skills needed for a new settlement, health, transport and the economy.

(6) This Clause would compel the Government to report to Parliament on the progress of the talks and resettlement.

Clause 4. Approval of Chagossians to transfer of sovereignty by Referendum

This clause provides for a referendum on any proposed transfer of sovereignty as per Clause 1.

Clause 5. Protection of British sovereignty in the BIOT Exclusive Economic Zone

This clause creates a duty on the Secretary of State to protect the EEZ. Particularly from illegal fishing but also other threats to the outer islands and to report annually on the progress.

Clause 6. Protection of biodiversity in BIOT

This clause creates a duty on the Secretary of State to protect and enhance the biodiversity in BIOT by mounting fisheries protection patrols (i.e illegal shark fishing), monitor habitats and continue the work on irradicating rats which harm the seabird populations.

The significance of this Bill

The timing of this new Bill could hardly be much worse for the Prime Minister. It represents yet another reminder of his failures on major matters of policy.

Crucially, it “puts down a marker”, in the words of the Bill’s authors to GB News, that no-one has forgotten this shameful episode. The Government has yet to make any definitive statement that its plans have been irrevocably changed and that the Chagos Islands will remain British.

Set to coincide with the Bill’s announcement today, a large number of Chagossians have been invited to Westminster Hall in the Palace of Westminster, to make their voices heard. This, say the Bill’s orginators, will highlight the embarrassment for the Government that the Chagossians were never consulted on its plans to give away their homeland.

As the Bill’s originators told GB News last night: “This Bill has support across parties. One thing is certain - Sir Keir will no longer be able to dodge the Chagos question.”
