THIS HAS BEEN AN EVOLVING STORY SINCE WE FIRST WROTE WHAT FOLLOWS DURING THE NIGHT
In light of events this morning we are now revising this report with more up-to-date information.
This morning for the first time in the UK, we exclusively revealed parts of the legal text of the ‘Great Gibraltar Giveaway Treaty’ between the UK, EU and Spanish governments. These included the establishment of an airport management company to manage the British MoD airport, as a 50/50 joint venture between the UK and Spanish. This company will be headquartered in an EU country.
It seems extraordinary that a British airport terminal built on British sovereign territory, owned by the Ministry of Defence and with the airport operated overall by the RAF, should have some form of management applied to it by an organisation only 50% controlled by the UK, and headquartered in an EU country. The intrusion of an EU country in any aspect of the running of the airport could be considered an incursion on British sovereignty.

It should be stated that RAF Gibraltar also acts as a key, strategic NATO base. Furthermore, and whilst details on this are naturally few and far between, Gibraltar is home to a major SIGINT base, which monitors traffic in the Mediterranean area and beyond.
Former Brexit Minister the Rt Hon David Jones, now head of Reform UK's campaign in Wales, commented exclusively to us

To contemplate placing a key national asset such as the airport terminal under the management of a foreign company, while granting Spain effective control over access by British citizens to our own territory, amounts to a clear surrender of sovereignty.

David Jones was a senior member of the former EU Scrutiny Committee in the House of Commons, where he took a particularly interest in Gibraltar.

The rush to get this Treaty "in force"
We can also reveal that this Treaty is set to be applied provisionally - including all its provisions – in advance of its full ratification. This will occur at the end of the month following completion of the new border works which have been under construction for many weeks by the Spanish and Gibraltarian governments. The Spanish government acquired an area of land for this purpose and it is thought this work will be accelerated. This includes a new road for the airport.

“The UK Parliament has still not had sight of the treaty document. This drip-drip of detail that we read or hear from others demonstrates exactly why Parliament needs to be able to see and scrutinise the detail.
It begs the question - Why, when others seem to have had sight of the detail, has it been kept away from our Parliament? It is outrageous to think that it could be applied provisionally in advance of ratification.”

Is the Government correct to have said UK sovereignty is not at stake? No.
[We wrote the following this morning, but again we were not wrong.] From the information we have been given, it seems that the Government's claims that no sovereignty is being ceded because of a clause inserted into the Treaty is at best disingenuous and at worse downright misleading.
What this clause appears to say is that no aspects of sovereignty are affected by the Treaty except those provided for in this very lengthy Treaty. The legal advice we have received on this appears to mean that many aspects of British sovereignty over Gibraltar could be ceded according to the full text. It is only those remaining which will be unaffected. We will be able to give more information on this shortly.

“This is a treaty of over a thousand pages with profound constitutional changes that fundamentally reshapes how Gibraltar’s border, airport and legal framework will operate, yet Parliament has not seen a single page of it.
“Gibraltar is British. Its people have repeatedly and overwhelmingly chosen to remain under British sovereignty. Any treaty that hands Spain new powers over entry, residency, infrastructure or enforcement must be examined line by line by Parliament before it takes effect.
“Parliament cannot be expected to sign a blank cheque to the EU. We need the full treaty in front of us before a single provision is allowed to take effect.”

Who decides who enters the British sovereign territory of Gibraltar?
The Agreement provides that all necessary immigration checks will take place at Gibraltar’s airport – and if needed, the port – rather than at the land border.
Is it remotely part of British sovereignty to allow the Spanish, on British soil, to "arrest, search, detain, interview, place under protection a person, or seize or search property"?
No. we didn't think so either. Yet this is what the Treaty says.
