EU Commission’s latest “infringement notices” for breaking EU laws include every EU country

Ursula's claim the EU is a ‘rules-based organisation’ is shredded by analysis of latest “infringements”

Last week the EU Commission issued its November list of EU countries breaking Ursula von der Leyen’s Rules, Regulations, Directives, and laws. It might be thought this would be a short list, considering the EU’s oft-repeated claim to be a ‘rules-based organisation’. Instead, the naughty list includes every single one of the EU’s 27 member countries.

It might also be thought that as the UK left the EU on 31 January 2020, it would not have received any infringement notices since that time. However, given the EU’s continual obsession with punishing the British people for daring to vote to leave, the Commission went into overdrive.

Below we summarise the latest announcements from Ursula von der Leyen’s Commission, to provide some sense of the lawlessness prevalent in the bloc. We also look at how the UK has been treated since it left the EU. This gives some context to the increasing number of demands being made on the UK since Sir Keir Starmer’s infamous “EU Reset Summit” in May.

1. Infringements by EU 27 countries – latest ‘naughty list’

In the EU Commission’s latest announcement regarding infringements by member states of its hundreds of thousands of EU Rules, Regulations, Directives, and laws, three main subjects are highlighted. These are:

  • Reinforced rules on energy efficiency
  • Updated list of feedstocks for the production of biofuels and biogas used in the transport sector
  • Amended Directive on markets in financial instruments

On energy efficiency Directives, it is easier to list the countries which have complied: Czechia. An astonishing 26 out of the 27 member states have failed to do what the (unelected) Commission says it must. That’s 96.3% of EU countries which seemingly are not too keen on putting the Commission’s rules on energy efficiency into law.

On animals producing biofuels and biogas, more of the EU countries escaped the Commission’s wrath, but the number still did not go beyond 45%. For readers who are interested, a total of 15 countries have committed the offence of ignoring Annex IX of the Renewable Energy Directive (Directive (EU) 2018/2001) (Parts A and B) as updated by the Delegated Directive (EU) 2024/1405.

Finally, regarding the Commission’s Amended Directive on financial instruments, the countries on ‘the naughty step’ are Belgium, Bulgaria, Germany, Estonia, Greece, Spain, France, Italy, Lithuania, Netherlands, Poland, Portugal and Romania. It seems they failed to fully transpose Directive (EU) 2024/790. This Directive amended the Directive on markets in financial instruments (Directive (EU) 2014/65/EU) to ensure coherence with the Markets in Financial Instruments Regulation ‘MiFIR'. 2. Number of infringements in the last 10 years

The above is merely a snapshot from November’s infringements coming out of the Commission’s HQ in Brussels. The Facts4EU team has once again analysed the EU’s legal database in order to give readers some sense of the scale of the work of Ursula von der Leyen’s Commission and its thousands of eurocrats, in holding its member states to account. Below is only a summary.

  • In the 10 years from 24 Nov 2016 to 24 Nov 2025 (today), the Commission has opened 7,742 proceedings
  • That is an average of 65 cases per month
  • 624 of these cases are still open

3. The UK and the EU’s pursuit of it on every legal detail it can find

  • Out of the total of 7,742 cases opened, only 210 were against the UK
  • That’s just 2.7%
  • However, almost half (101) of these cases were opened AFTER the UK left the EU

The UK had a proud record of implementing all the hundreds of thousands of EU Rules, Regulations, Directives, and laws while it was a member. Cases opened against the United Kingdom were significantly below the average that would be expected.

All of that changed after the UK left the EU, however. It would of course be expected that the number of cases would drop dramatically from the 108 that were opened in the preceding five years. Instead, the number of cases has continued at broadly the same rate, despite the fact that the UK is supposedly no longer subject to the EU’s laws.

Observations

This is a subject we shall return to.
