Starmer’s latest EU deal is so bad it’s almost impossible to imagine it being any worse unless the EU insists at the last minute he must also sing ‘Ode to Joy’ when he stands up at Prime Minister’s Questions each week.

On Wednesday we saw the EU quietly publish the first texts on one of the deals Sir Keir Starmer agreed with them in his ‘Great EU Reset Summit’ – regarding UK food trading and standards. As we show below, that ‘Summit’ is rapidly justifying the sobriquet we gave it at the time: ‘The Great UK Summer Sale’.

‘SPS’ – ‘Surrendering, Prostrating, Submitting’ – the EU’s Agri-Food deal

When the EU wants to hide something, they will often disguise it in obscure language. Readers will be aware of the term “Sanitary and Phytosanitary” area, or SPS for short. The term ‘organic’ in the longer description simply means ‘living’, not the term applied in supermarkets for food produced naturally.

Let’s cut through all the jargon. This deal is about what we eat, how it’s sold to us, what we produce agriculturally including our animals, and even what we import to eat. To quote the EU it includes:

“The production, distribution and consumption of agrifood products, the regulations of live animals and pesticides, the rules on organic production and labelling of organic products, as well as marketing standards applicable to certain sectors or products. All of these areas should be addressed in their entirety, including the enforcement of legal requirements and the rules on certification and official controls.”

Under what is surely one of the worst international deals in history, the EU gains on everything and the United Kingdom loses on everything. There is simply no upside for the UK – it’s pain all the way, up to and including higher prices for food we would not choose… but we are given no alternative.

Before getting into the details of the deal, it’s helpful to start with some background.

Fact 1 – Why is the EU so desperate for this deal with Starmer?

Putting aside the fact the EU wants to bring the UK back under its control – which this deal does – it is not generally stated in the mainstream media but the UK is the EU’s No.1 market in the world for agri-foods.

Unlike the EU, the UK has not yet imposed the various controls on the imports of EU agri-foods that it should have done. These have been deliberately delayed and delayed, but are due to kick in next year. Conversely, the EU implemented its controls very quickly and has made it as difficult as possible for the UK to sell to the EU. Even New Zealand has a better deal than the one the PM is negotiating. The EU simply recognises the NZ food standards as being equivalent to its own. No payments, no submission to EU standards or laws.

What follows are verbatim quotes from the EU Commission’s text about this agreement, followed by our translations. Where the quotes refer to agreements in the plural, they are also referring to a separate deal on carbon emissions. We will be reporting on that deal separately at some point soon, but this report is exclusively about agri-foods.

The UK will be judged by a foreign court with no UK representation

What the EU says:
“Both agreements should ensure uniform interpretation and application of Union law on the basis of the case-law of the Court of Justice of the European Union; in particular, the interpretation given to the applicable rules within the Union should also apply in the context of the relations between the Parties.”

What the EU means:
The UK must submit wholly to the supremacy of a foreign court over which it has no say and which makes law as it goes along. The UK will have no judge on the panel. This is a BIG change. The Trade & Cooperation Agreement has no role for the ECJ.

Any disputes? The EU is always right

What the EU says:
“Both agreements should include effective mechanisms for dispute resolution involving an independent arbitral tribunal and ensuring that the Court of Justice of the European Union is the ultimate authority for all questions of European Union law, with possibilities for appropriate measures to protect the Union interests in case of non-compliance with the agreements.”

What the EU means:
The Court of Justice of the European Union (ECJ) is sovereign over the EU’s courts and Parliament.

If the UK doesn’t comply, the EU can punish the UK severely

What the EU says:
“The agreements should include provisions to ensure that cross-retaliation between the new agreements and the areas covered by the Trade and Cooperation Agreement remains possible as contemplated in the Trade and Cooperation Agreement.”

What the EU means:
If the UK transgresses on food, the EU can impose large penalties in any other areas of the UK-EU relationship it chooses, for example imposing large tariffs on UK goods.

The UK must pay for surrendering completely to the EU

What the EU says:
“BUDGETARY IMPLICATIONS - The agreements should include provisions to ensure the United Kingdom contributes financially to support the Union’s work in these policy areas.”
AND (just to emphasise the point) “The United Kingdom should contribute financially to support relevant costs associated with the Union's work in these policy areas.”

What the EU means:
The EU will decide what it thinks the UK should pay into the EU budget each year, to pay for its total subservience to the EU on this agri-food (SPS) agreement. The EU will include absolutely every cost it can think of, knowing that this government will pay it. There is no mechanism for the UK to discuss or negotiate this amount.

Observations

As we have shown, the UK is the EU’s No.1 market in the world for agri-food. Not only that but the whole area of farming is highly politicised in the EU, particularly in certain countries such as France, Spain, and Italy. It takes very little for the tractors to take to the streets in Macron’s France, for example, and to blockade Paris’s arterial roads leading into it completely.

For the EU to secure unfettered access to its largest export market is worth a great deal – politically as well as economically. For it to be able to do so while exacting the most demanding terms one can imagine from the other side is scarcely credible, but with this Prime Minister so starstruck and so obsessed with rejoining the EU then perhaps anything is possible.

Having made some bold claims in this report, we will follow it up with a second, providing the evidence from what the EU Commission has written about this agreement. This has not been published by the Commission’s Press Office, but under its transparency rules it is forced to disclose it even if this is in a more discrete location.

We will reveal the most shocking paragraphs, together with our clear description of what the EU actually means by each. It is then up to readers to decide if this is one of the most scandalous breaches of public trust by this government or not.
