As Facts4EU predicted in April, the Civil Service’s data on EU laws has now proved to be pitiful. We detailed the number of EU laws identified by each Department and they totalled 3,745. At the time, we stated we simply did not believe the number and explained why in the next part in this series here.

On Wednesday this week (10 May 2023) the Civil Service corrected their figures, and raised them by an astonishing 1,084. This takes the total to 4,829. Unfortunately we do not believe this number either. We believe the total number to be much, much higher.

Even worse, the Government is now breaking its promise to appeal or amend these EU laws.

Four Departments have only just started reporting

When we last accessed the data in April, the Civil Service had not even included four Departments or Agencies: the Health & Safety Executive (392 laws), the Dept for Energy & Net Zero (189 laws), the Dept for Science, Innovation & Technology (156 laws), and the Food Standards Agency (112 laws).

Given that these departments have only just started reporting, we believe it is inevitable that their new numbers will rise significantly.

Rishi Sunak has broken his promises again

On Wednesday (10 May 2023) the Secretary of State for Business and Trade, the Rt Hon Kemi Badenoch MP made a statement to the House of Commons which was quite extraordinary. In it, she announced a dramatic rowing back from the promise made by the Prime Minister in his leadership campaign only last year.

Originally all EU laws were to be repealed by the end of this year, if they had not been amended. Now this pledge has been dropped. Kemi Badenoch announced that the Government only intends to revoke “around 600 directly through the REUL Bill”.

Observations

Regular readers will know that Facts4EU predicted all of this in advance. We said there were far more EU laws than had been declared by the Civil Service. On Wednesday they admitted to another 1,100 and we are sure there are thousands more to come.

We also predicted the Government would row back on its ‘sunset clause’ in the REUL Bill, which would have meant all EU laws being revoked if they had not been amended and incorporated into UK law by the end of this year.

Sadly, both of these predictions have come true.

Kemi Badenoch claimed yesterday that she is doing what can be done. We would qualify this and say the Civil Service is doing what little it is capable of, or willing to do. We continue to maintain that almost seven years after the vote to leave the EU, they are guilty of a combination of obstructionism, inertia, and incompetence.

We say this based on off-the-record conversations we have had with senior politicians who have witnessed this behaviour at first hand.

Yesterday the head of the Civil Service’s union declared how unhappy he is at the criticism. We would say: “Comrade, if the cap fits, wear it.”

We must get reports like this out there

Reports like the one above take far longer to research, write and produce than many people realise. If they were easy, readers would see other organisations also producing these daily.
