Happy Independence Day to all readers!

Brexit Facts4EU.Org would like to wish all readers a very Happy Independence Day for yesterday and today! As has become traditional amongst our team, we invite you to watch with us that magnificent moment when the BBC’s David Doombleby was forced to announce that Leave had won the EU Referendum.

This was the moment at 04.40am on 24 June 2016 when millions across the land leapt for joy, punched the air, hugged loved ones, or otherwise celebrated the result of the biggest vote for anything in the history of the United Kingdom. On 23 June 2016 we voted to take back control of our lives from the oligarchical, federalist technocrats of the European Union.

It was also the moment when the Establishment was delivered the biggest shock to its foundations in generations. The contrast between the reaction of the BBC and the reactions across the country was stark. Perhaps never before has the national broadcaster been so out of touch with the majority of its audience.

Three years on, what’s to celebrate?

After three years of broken promises from the political class, some might argue that we have little to celebrate. We prefer the more positive approach. A very large number of people worked very long hours for many months – and in many cases years and even decades - to achieve a Leave victory. Without that result three years ago there would not be a Brexit path to be disappointed about.

So, despite the shocking lack of progress, let’s celebrate this third anniversary with pride. Against all the odds, we did it. We won. Now we’re on the final push to ensure that our victory is finally honoured.

Four more months

In his regular column in today’s Daily Telegraph, Tory leadership contender Boris Johnson says:

“We are just over four months away from the date on which, by law, we must leave the EU; and this time we are not going to bottle it. We are not going to fail. This time we are not going to shrink in fear from the exit, as we have on the last two occasions.
“We are going to show all the mettle, the creativity and the energy of this amazing nation. We are going to focus all our efforts on honouring that single great promise – and we are going to come out of the EU on October 31. We can, we must and we will.”

Party on!

Today is not the day for us to critique the current situation, nor to highlight our concerns. Instead let’s simply celebrate one of the best decisions the great British public ever made. Party on, everyone!

Readers might note that around 25 minutes into the programme, the BBC presenters' faces are all smiles, when they reveal that a YouGov poll after the vote predicted a win for Remain by 52% to 48% - the opposite of the actual result!

Boris said "we are going to come out of the EU on October 31. We can, we must and we will." - I hope for his sakes he is PM and we do just that.
Of course the swamp will be tearing its collective hair out. The EU has said it won't speak with Johnson as PM. With reactions like this, I think he would be a perfect PM.
Your article is correct, whilst I am depressed that after 3 years we are seemingly no nearer the exit door, one has to celebrate today as the momentous day probably in my entire life. A reversal of the stupid decision to join the so-called common market, after more than 40 years of seeing our country belittled we voted to leave. I call that exciting and envigourating for the country.

Comment 1 - Not a Lemming - Share your sentiments and leaving the EU is the second most important battle in our lifetimes and in this century and losing is NOT an option. We WILL beat the Establishment and hearing that the EU won't speak to Boris if he becomes PM, should renew our determination to break free from these arrogant Dictators.
Hearing that Leave had won the Referendum was one of the best days of my life also and the joy was enhanced when witnessing the utter shock and disbelief of Dimbleby when he had to announce the result. How DARED the peasants vote for the dignity of freedom from slavery, for independence and sovereignty!
Boris Johnson may be the 'least worst option', but he is our best option compared to the hypocrite Remainer Hunt. Perhaps we should all send Boris some encouragement and support? Should Boris fail, it is the Brexit Party all the way and possibly civil unrest. Just look at the recent achievement of the 2 million strong demonstrations in Hong Kong - SURELY we can do just as well?

Article 50 TEU at paragraph 3 specifies that an extension is made within the two year period ending on 29th March and is continuous with it.
Any extension granted, takes the UK beyond the set time limit of two years for concluding an agreement. It follows that a further extension cannot be made within and be contiguous with the two year period. Paragraph 3 does not mention a second or more extensions.
In offering alternative extension lengths the Council appear to be very divided and confused on the reasons for granting them.
With the passage of time the extended leaving date became 12th April. The WA was not agreed, being voted down a third time, so exit day became 11 pm 12th April.

Comment 3 Barbara Jell, yes I remember how elated I was 3 years ago, finally after decades the chance came for the reversal and people took to it. At first I could hardly believe that over 17 million had voted to leave! Then I saw the establishment faces and I was so happy.

Sydney Ashurst (post #4). Whilst we are discussing Article 50, there is a much more glaring anomaly than the legality of the extension. It is not nuanced nor does it need any expert legal interpretation, it says what it says.
And that is, <<the Union shall negotiate and conclude an agreement with that State, setting out the arrangements for its withdrawal, **taking account of the framework for its future relationship with the Union.** >>(my asterisks).
The current WA explicitly does NOT take into account the future relationship. It goes completely against the plain English of Article 50. Why is there no legal challenge to this ?

Theresa May and her Cabinet fell into the trap of accepting Article 50 as the route to leave. It gave the Commission the right to compose the WA and the Political Declaration.
The much vilified Gina Miller saved our bacon by removing the prerogative of Theresa May to Parliament to vote and pass the WA. At the third attempt 34 Conservative MP's held firm against it. Parliament challenged it. Some MP's read the WA or the reviews of it.
The legality of an extension to 31st October could be challenged, but on that date we will leave by default.
The Prime Minister is the supplicant who must ask for the extension.
