At the weekend, two Government ministers confirmed what most people already suspected. IF Boris Johnson is able to negotiate something with the EU by the Council Summit of 17/18 October, the only major change to Mrs May’s Surrender Treaty (known more formally as the ‘Withdrawal Agreement and Political Declaration’) will be a change to the Northern Ireland Backstop.

Speaking to the BBC yesterday, the Brexit Secretary the Rt Hon Stephen Barclay MP said :

Changes to Britain’s trading relationship with the EU “do not apply until the end of the implementation period, which is December 2020 or one or two years later by mutual agreement.”

Also speaking to the BBC, Home Secretary the Rt Hon Priti Patel MP, once a fervent Brexiteer, was asked :

“If he [Boris Johnson] deals with the Backstop, Priti Patel votes for it?”

Her answer was “Yes” and “Absolutely.”

May’s Surrender Treaty without the Backstop still isn’t Brexit

Steve Baker MP, Chairman of the ERG group of Eurosceptic Conservative MPs, commented last night on the story in the Sun newspaper that the Chief Whip is now promising the Prime Minister that only 8-10 Tory Brexiteer MPs will vote against a modified “May 2.0” Surrender Treaty.

Mr Baker’s very pointed comment shows what he thinks of the idea of being forced to vote for “May 2.0”.

Observations

Whilst it is evidentially foolish to predict the next twists and turns in the Establishment’s attempts to thwart the democratic decision of the British people, there are now major indicators of a “Grand Brexit Stitch-Up”.

Despite his claims that “The Withdrawal Agreement is dead”, it now seems that the Prime Minister is prepared to re-present it to Parliament next month, with changes which will fall far short of what is needed.

Barring some cunning plan, we cannot see any other way that the PM can pretend to keep his promise to leave on 31 October – even though we will not in fact leave on that date by any practical interpretation of what Brexit means. Worse, we expect the ‘deal’ to continue to contain clauses which make the UK a powerless colony of the EU for several more years.

We’re fighting back

Plus of course we have the 'Liberals' and that EU Guy Verhofstadt happy to wave their childish t-shirts at the 'Liberals' conference "Bollocks to Brexit" - one could say the same for Guy, what the heck is he doing again campaigning with that excuse for a party in England?

I suggest everyone reads or listens to the UK Column too. There you learn what insidious things are continuing despite and in spite of Brexit planning......especially to do with our ability to defend our country. It would seem that the other side EU and remoanians are quite happy to give away our forces secrets and equipment. The end story of that of course is that want NO nation states in the EU. Without armed forces under our control the country is dead.

Concerned - just a reminder about the UK giving away secrets. Mrs May's Withdrawal Agreement provides that the UK has to share secret material with the EU, but, guess what .. You're right: the EU does not! (article 8)
Very disappointed in Priti Patel. She should be pushing Boris & co to insist on a decent deal.

Concerned (2), yes it is disgraceful that Lord James should be threatened like that for simply asking, in the Lords, for the people to be properly informed about the continuing plan for our military & defences, which appears to confirm a continuing policy of submission to & subjugation by a foreign power and like all things EU, the truth is being hidden from the public. No wonder May rushed to sign us up to parts of the EU that we've never belonged to, AFTER we voted to leave, & the retained EU claws of control are set out in the atrocious 'WA & PD'. On 23rd June 2016, we voted to LEAVE the EU.
On 23rd June 2016, we voted for British Independence from the sclerotic & corrupt wannabe totalitarian empire, the EU.
On 23rd June 2016, we voted to restore full sovereignty to our country, with our laws & controls made by people totally accountable and responsible to US, the people.
We expect that decision to be implemented in full.
We do not want, nor expect, 'compromise' on a binary decision.
It is now clear that any pre-leave 'deal' cedes elements of sovereignty & control, that we voted to take back on 23rd June 2016, to the EU, ie a brand new Treaty of subservience allowing the ratchet of control to be reapplied. Pre-referendum, the 'deal' referred to was a TRADE deal. The EU have made it clear that a trade deal can only be agreed AFTER we have left. They 'do not negotiate with members'. Consequently, the only way to honour the democratic mandate is to leave cleanly, on WTO terms, & THEN agree a trade deal. If that does not happen, the ballot box will have demonstrably failed & the facade of democracy in this country will be shown to be dead.

If we compare the European Withdrawal Number 2 Act with the Cooper-Letwin Act, it is enacted in bad faith. It serves no purpose whilst the latter is open until the 31st October, and the primary purpose and condition for the extension – to ratify an unamended Withdrawal Agreement - has not been enacted by Parliament. With the number of MP's against leaving the EU it is never likely to be passed. the “Benn Act“ is an attempt to kick it down the road.
Let us look at the terms and conditions imposed and accepted by Thersa May. By letter of 5 April 2019, the United Kingdom submitted a request for a further extension of the period provided for in Article 50(3) TEU, as extended by the European Council, until 30 June 2019, with a view to finalising the ratification of the Withdrawal Agreement.
On 10 April 2019, the European Council agreed to a further extension to allow for the ratification of the Withdrawal Agreement by both Parties. Such an extension should last as long as necessary and, in any event, no longer than 31 October 2019.
This extension excludes any re-opening of the Withdrawal Agreement. Such an extension cannot be used to start negotiations on the future relationship.
These T & C's close the door to any negotiation concerning the backstop or requiring reopening the WA or discussing the political Declaration,
The Stephen Kinnock amendment is a dead parrot as it comes under the political declaration.
As no progress can be made with European Union (Withdrawal) (Nos 1 &.2) Act 2019 the PM cannot be held in contempt if he does not progress the extension request.

Johnson may be about to push a watered down WA through ( sorry, try to; the Labour Party and "friends" in Parliament would still block it in favour of Revoke, I suspect) but he must surely be aware that he'd be signing the Tory Party death sentence?

Comment 6 Carol W, "he'd be signing the Tory Party death sentence" - after Heath, Major, Cameron, and May - I do hope that the so-called Conservative party does die. When you see what treaties they have signed along with Blair and Brown.
The ERG and other real conservatives should form a pact with the Brexit party - otherwise the Conservatives are finished. They must deliver the leave referndum vote or else the mother of parliaments is dead. Great message they are sending out to Hong Kong and South African whites...... yet another reason to despise the current Conservative party.
As for the Marxist Labour party and the Liberal dreamers, they combine with most of the rest of parliament to make the UK look weak and in no position to defend itself.

Take another look at the fracas over reintroducing the “meaningful vote” again and again in the same parliamentary session. Bercow will act to prevent our leaving the EU.
A fourth attempt stands no chance of being passed by Parliament.
Boris Johnson in the pretext that he wants a deal, is passing time to leaving on 31st October.
As I said earlier he cannot be held in contempt for not requesting an extension that does not meet its T & C's.

I certainly hope your new initiative succeeds.
There are reports in the press that a cunning plan may indeed be afoot, which involves a legal challenge to the Benn Bill, and proroguing Parliament again (assuming the Supreme Court upholds the London High Court ruling).
I'm not too concerned about the May WA, provided it doesn't impact on our ability to strike independent free trade deals, or if such restrictions can be ignored as they breach International law. The key will be a US deal, as that would then form the template for similar deals with Oz, NZ, Japan, etc. The decline in EU trade as a percentage of the total will then accelerate and quickly become irrelevant. Liz Truss is doing a brilliant job so far in that respect.
